Simple Home Comfort’s Maintenance Agreement Terms and Conditions

We agree to accept responsibility for your 100% complete satisfaction with the
materials and the work provided by us and paid for by you.
EQUIPMENT: The annual / monthly investment to be paid by Customer under this agreement is based upon the maintenance of the Equipment and Accessories from the annual / monthly maintenance provided hereunder. In the event additional equipment is added to Customer’s heating and/or air conditioning system, the same will be covered at an increase of the annual / monthly charge.
CUSTOMER’S RIGHT TO CANCEL: Customer may cancel an annual / monthly Agreement by mailing a written notice of cancellation to Simple Home Comfort, hereinafter referred to as “Company.” In the event of cancellation by Customer, Customer may receive a prorated refund of the payments made by Customer for the current term of this Agreement.
TERMS ON MAINTENANCE CONTRACTS: Terms lengths for monthly payment plans are as followed. All monthly plans are for a minimum term of 36 months or longer. If customer received discount on signup, months 1-12, 100% of signup discount is required to cancel contract. Months 13-36 discount will be prorated, and remainder balance will be determined. Monthly maintenance payments do not apply to discount payments. Maintenance plans provided by company free of charge during an install and have no value and are not eligible for any type of refund or proration. Yearly Maintenance Plans if discounts were given to sign up. 100% of signup discount will be required to cancel plan if within 0-12 months. Thereafter, a proration of discount will be determined. Also, Policy visits and service calls used will be prorated in conjunction with determining discounted refund.

Condensate Drain Lines: No Warranty
Any Type of Refrigerant: No Warranty
EMERGENCY SERVICE TODAY OR YOU DON’T PAY: Company agrees that it shall respond for emergency service within 24 hours of the service call and, if it fails to do so, shall waive the service fee normally charged for such an emergency service call.
TRANSFERABILITY: In the event of a change in home ownership, warranties provided as a result of this Agreement are not transferable to the subsequent owner of the home in which the Equipment and Accessories are located. New homeowner will receive the agreed maintenance visits, but warranties will not follow. New homeowner can sign up on new maintenance contract and reinstate such warranties within 60 days after close of escrow on home.
ENTIRE AGREEMENT: This Agreement sets forth the entire Agreement between the parties and supersedes all other agreements either written or oral concerning the subject of the Agreement. Customer affirms (s)he is the homeowner/authorized agent of the address for which this agreement is in force.
